Article R513-7 of the French Insurance Code

The association verifies that its members comply with the obligation to take out a financial guarantee as set out in article L. 512-7.

It ensures that the amount of the guarantee referred to in article R. 512-7 is calculated in accordance with the applicable regulations and that it covers the reimbursement of funds actually collected by its members.

To this end, each member must provide the association with an annual statement indicating the amount of the financial guarantee taken out, the amount of funds collected and the working capital at its disposal, as well as the mandates for collecting premiums or subscriptions and settling claims. It shall keep the supporting documents for this declaration at the Association’s disposal.

L’association vérifie que ses membres respectent l’obligation de souscription d’une garantie financière prévue à l’article L. 512-7.


Elle s’assure que le montant de la garantie mentionné à l’article R. 512-7 est calculé conformément à la réglementation applicable et qu’il couvre le remboursement des fonds réellement encaissés par ses membres.


A cette fin, tout membre fournit chaque année à l’association une déclaration indiquant le montant de la garantie financière souscrite, le montant des fonds encaissés et des fonds de roulement dont il dispose ainsi que les mandats d’encaissement des primes ou des cotisations et de règlement des sinistres. Il tient les éléments justificatifs de cette déclaration à la disposition de l’association.
