Article R5134-54 of the French Labour Code

In the event of non-compliance by the employer with the provisions of the decision awarding the work placement subsidy, the subsidy will not be due and the sums paid will be reimbursed.

The authority awarding the aid informs the employer of its intention to recover the undue payment.

The employer has seven days in which to make its observations known.

Any undue payment will give rise to reimbursement by the employer of all aid received.

The authority awarding the aid will inform the body responsible for collecting social security contributions of the procedure.

En cas de non-respect par l’employeur des dispositions de la décision d’attribution de l’aide à l’insertion professionnelle, cette aide n’est pas due et les sommes versées font l’objet d’un remboursement.

L’autorité attribuant l’aide informe l’employeur de son intention de procéder à la récupération de l’indu.

L’employeur dispose d’un délai franc de sept jours pour faire connaître ses observations.

Tout paiement indu donne lieu à remboursement par l’employeur de la totalité des aides perçues.

L’autorité attribuant l’aide informe l’organisme de recouvrement des cotisations sociales de la procédure.
