Article R5134-57 of the French Labour Code

The maximum duration of employability assistance, set at twenty-four months by article L. 5134-67-1, may be extended, in application of the third paragraph of the same article, for the remaining duration of the training followed by the employee, up to a maximum of sixty months.

The employer’s request for extension must be accompanied by :

1° All supporting documents intended to establish that the vocational training leading to qualifications referred to in article L. 6314-1 provided for under the initial aid granted is being carried out and that the end of this action exceeds the end of the aid ;

2° Organisational details of the training activities to ensure that they can be carried out during the extension period.

La durée maximale de l’aide à l’insertion professionnelle, fixée à vingt-quatre mois par l’article L. 5134-67-1, peut être prolongée, en application du troisième alinéa du même article, pour la durée de la formation suivie par le salarié restant à courir et dans la limite de soixante mois.

La demande de prolongation faite par l’employeur est accompagnée :

1° De tous justificatifs visant à établir que l’action de formation professionnelle qualifiante visée à l’article L. 6314-1 prévue au titre de l’aide attribuée initiale est en cours de réalisation et que le terme de cette action dépasse le terme de l’aide ;

2° Des éléments d’organisation des actions de formation permettant de s’assurer qu’elles pourront être réalisées durant la période de prolongation.
