Article R521-2 of the French Insurance Code

I.-The standardised information document on the insurance product referred to in article L. 112-2, as well as any other information provided by a distributor pursuant to articles L. 521-1 to L. 521-3 and articles L. 522-3 and L. 522-4, are communicated to the policyholder or member in a clear, accurate and non-misleading manner.

If, pursuant to the provisions of article L. 521-6, this information is communicated by means of a durable medium other than paper, or an Internet site, a paper copy is provided free of charge to the subscriber or member at his request.

The distributor verifies that the provision of information on a durable medium other than paper, or by means of an Internet site, is appropriate to its commercial transactions with the subscriber or member. The provision by the subscriber or member of an electronic address for this purpose, the validity of which is verified by the distributor, constitutes evidence in this respect.

II – The provisions of article L. 112-2-1 apply to pre-contractual information provided to policyholders or members in the case of distance marketing of a contract. In addition, where the insurance contract has been concluded at the request of the policyholder or member using a distance technique that does not allow information to be transmitted on paper or another durable medium, the distributor shall make the information relating to this contract available to the policyholder or member on paper or any other durable medium to which he has easy access, immediately after the conclusion of the contract.

Article R521-2

I.-Le document d’information normalisé sur le produit d’assurance mentionné à l’article L. 112-2 ainsi que toute autre information fournie par un distributeur en application des articles L. 521-1 à L. 521-3 et des articles L. 522-3 et L. 522-4, sont communiqués au souscripteur ou à l’adhérent de manière claire, exacte et non trompeuse.

Si, en application des dispositions de l’article L. 521-6, ces informations sont communiquées au moyen d’un support durable autre que le papier, ou d’un site internet, un exemplaire sur support papier en est gratuitement fourni au souscripteur ou à l’adhérent à sa demande.

Le distributeur vérifie que la fourniture d’informations sur un support durable autre que le papier, ou au moyen d’un site internet, est appropriée à ses opérations commerciales avec le souscripteur ou l’adhérent. La fourniture par le souscripteur ou l’adhérent d’une adresse électronique à cette fin, dont la validité est vérifiée par le distributeur, constitue un élément de preuve à cet égard.

II.-Les dispositions de l’article L. 112-2-1 s’appliquent aux informations précontractuelles fournies au souscripteur ou à l’adhérent dans le cas de commercialisation d’un contrat à distance. En outre, lorsque le contrat d’assurance a été conclu à la demande du souscripteur ou de l’adhérent en utilisant une technique à distance ne permettant pas la transmission des informations sur support papier ou sur un autre support durable, le distributeur met les informations relatives à ce contrat à la disposition du souscripteur ou de l’adhérent sur support papier ou tout autre support durable auquel il a facilement accès, immédiatement après la conclusion du contrat.
