Article R6122-32-1 of the French Public Health Code

The application for renewal that the holder of an authorisation submits, in accordance with the conditions laid down in article R. 6122-28, includes:

1° The applicant’s undertaking to implement and maintain the conditions for the location of care activities and heavy equipment, as well as the technical operating conditions laid down in application of articles L. 6123-1 and L. 6124-1;

2° The number and qualifications of the medical and paramedical staff assigned to the activity for which renewal is sought;

3° The changes that the authorisation holder plans to make, for the period of validity of the authorisation for which renewal is sought, to the following points:

a) The objectives of the regional or inter-regional health plan to which the applicant intends to respond, as well as the quantitative objectives of the health care supply;

b) Any cooperation agreements entered into by the applicant and a mention of its membership, where applicable, of the health networks defined in article L. 6321-1;

c) The staffing levels referred to in 2°;

d) The organisation of the facilities, services or heavy equipment, showing compliance with the conditions of location and technical operating conditions laid down in 3° of Article L. 6122-2, set out in a brief description of the planned change.

If these changes are not sent, the renewal is considered to have been applied for on an identical basis.

Article R6122-32-1

La demande de renouvellement que le titulaire d’une autorisation transmet, dans les conditions prévues par l’article R. 6122-28, comprend :

1° L’engagement du demandeur sur la réalisation et le maintien des conditions d’implantation des activités de soins et des équipements matériels lourds ainsi que des conditions techniques de fonctionnement fixées en application des articles L. 6123-1 et L. 6124-1 ;

2° L’état des effectifs médicaux et paramédicaux affectés à l’activité dont le renouvellement est demandé et leur qualification ;

3° Les modifications que le titulaire de l’autorisation envisage, pour la durée de validité de l’autorisation dont il sollicite le renouvellement, sur les points suivants :

a) Les objectifs du schéma régional ou interrégional de santé auxquels le demandeur entend répondre ainsi que ceux, quantitatifs, de l’offre de soins ;

b) Les conventions de coopération passées, s’il y a lieu, par le demandeur et la mention de son appartenance, le cas échéant, aux réseaux de santé définis à l’article L. 6321-1 ;

c) L’état des effectifs mentionnés au 2° ;

d) L’organisation des installations, des services ou des équipements matériels lourds faisant apparaitre le respect des conditions d’implantation et des conditions techniques de fonctionnement prévues au 3° de l’article L. 6122-2, retracée dans un descriptif succinct de la modification projetée.

En l’absence de transmission de ces modifications, le renouvellement est considéré comme étant sollicité à l’identique.
