Article R6122-35 of the French Public Health Code

In the event of a transfer of authorisation, including when this transfer is the result of a merger, the transferee must send the General Director of the Regional Health Agency a request for confirmation of the authorisation. This request may be submitted outside the periods mentioned in article R. 6122-29.

This request for confirmation is accompanied by a dossier, the composition of which is set by order of the Minister for Health.

The Regional Health Agency decides on this request in the same way as for an application for authorisation. It may refuse to confirm the authorisation only if the dossier submitted by the transferee shows changes that would justify refusal of authorisation in application of the provisions of article R. 6122-34 or that would be incompatible with compliance with the conditions and commitments to which the transferred authorisation was subject.

Article R6122-35

Dans le cas de cession d’autorisation, y compris lorsque cette cession résulte d’un regroupement, le cessionnaire adresse au directeur général de l’agence régionale de santé une demande de confirmation de l’autorisation. Cette demande peut être déposée en dehors des périodes mentionnées à l’article R. 6122-29.

Cette demande de confirmation est assortie d’un dossier dont la composition est fixée par arrêté du ministre chargé de la santé.

L’agence régionale de santé statue sur cette demande suivant les modalités prévues pour une demande d’autorisation. Elle ne peut refuser la confirmation de l’autorisation que si le dossier présenté par le cessionnaire fait apparaître des modifications qui seraient de nature à justifier un refus d’autorisation en application des dispositions de l’article R. 6122-34 ou qui seraient incompatibles avec le respect des conditions et engagements auxquels avait été subordonnée l’autorisation cédée.
