Article R6122-44 of the French Public Health Code

The hierarchical appeal provided for in article L. 6122-10-1 lodged against the decision of the Director General of the Regional Health Agency suspending an authorisation, maintaining the suspension, amending or withdrawing an authorisation pursuant to articles L. 6122-12 and L. 6122-13, shall be lodged within the time limit and in accordance with the procedures provided for in article R. 6122-42.

The decision is considered to be confirmed by the Minister on expiry of the six-month period running from the date of receipt of the appeal if no express decision has been taken within this period.

Article R6122-44

Le recours hiérarchique prévu à l’article L. 6122-10-1 exercé contre la décision du directeur général de l’agence régionale de la santé prononçant la suspension d’une autorisation, le maintien de la suspension, la modification, le retrait d’une autorisation en application des articles L. 6122-12 et L. 6122-13, est formé dans le délai et selon les modalités prévues à l’article R. 6122-42.

La décision est considérée comme confirmée par le ministre à l’expiration du délai de six mois courant du jour de la réception du recours si aucune décision expresse n’est intervenue dans ce délai.
