Article R6123-123 of the French Public Health Code

Authorisation for medical care and rehabilitation may only be granted if the holder has, on its own site or by agreement with another structure:

1° For all establishments, whatever the category applied for:

a) Access to a scanner and magnetic resonance imaging;

b) The possibility of having medical biology analyses carried out;

2° For all establishments applying for the following categories, respectively:

a) Access to a CT scanner and magnetic resonance imaging adapted to the care of patients with severe obesity for the “digestive system, endocrinology, diabetology, nutrition” option;

b) Access to an intensive care unit as provided for in article R. 6123-34-3 for the “nervous system” option, supplemented by an agreement with a holder of an authorisation for neurosurgery if the establishment does not have one;

c) Access to a cardiology intensive care unit as provided for in article R. 6123-34-1 for the “cardiovascular” option;

d) Access to either an intensive care unit or an intensive care unit as provided for respectively in articles R. 6123-34-3 and R. 6123-34-3 respectively for the “pneumology” option;

e) Access to an establishment authorised to carry out the activity of treating severe burns, as provided for in 9° of Article R. 6122-25 for the “burns” option;

f) Access to a paediatric intensive care unit, as provided for in Article R. 6123-34-3 for the “paediatrics” option;

g) Participation in a specific regional cancer scheme mentioned in article R. 6123-91 of the present code for the “cancers” modality.

L’autorisation de soins médicaux et de réadaptation ne peut être accordée que si le titulaire dispose, sur son site ou par convention avec une autre structure :

1° Pour tout établissement quelles que soient les mentions sollicitées :

a) D’un accès à un scanographe et à une imagerie à résonance magnétique ;

b) De la possibilité de faire réaliser des analyses de biologie médicale ;

2° Pour tout établissement sollicitant les mentions suivantes, respectivement :

a) D’un accès à un scanographe et à une imagerie à résonance magnétique adaptés à la prise en charge des patients avec obésité sévère pour la mention “ système digestif, endocrinologie, diabétologie, nutrition ” ;

b) D’un accès à une unité de réanimation prévue à l’article R. 6123-34-3 pour la mention “ système nerveux ”, complété d’une convention avec un titulaire d’une autorisation d’activité de soins de neurochirurgie si l’établissement n’en dispose pas ;

c) D’un accès à une unité de soins intensifs en cardiologie prévue à l’article R. 6123-34-1 pour la mention “ cardio-vasculaire ” ;

d) D’un accès soit à une unité de réanimation soit à une unité de soins intensifs prévues respectivement aux articles R. 6123-34-3 et R. 6123-34-3 pour la mention “ pneumologie ” ;

e) D’un accès à un établissement autorisé à exercer l’activité de traitement des grands brûlés prévue au 9° de l’article R. 6122-25 pour la mention “ brûlés ” ;

f) D’un accès à une unité de réanimation pédiatrique prévue à l’article R. 6123-34-3 pour la modalité “ pédiatrie ” ;

g) De la participation à un dispositif spécifique régional du cancer mentionné à l’article R. 6123-91 du présent code pour la modalité “ cancers ”.
