Article R6123-133-2 of the French Public Health Code

I.- Authorisation to carry out interventional cardiology imaging may only be granted, maintained or renewed if the holder of the authorisation complies, for each authorised geographical site, with a minimum annual activity set, taking into account, where applicable, the nature of the procedures, by order of the Minister for Health.

In the case of a new establishment, the minimum annual activity is forecast for the first year.

Annual activity is established by reference to certain procedures mentioned in article R. 6123-129.

II – In the event of an exceptional and temporary event leading to a significant drop in activity, the Director General of the Regional Health Agency may, at the express request of the holder, suspend the application of I of this article for a maximum period of one year, provided that the holder has made commitments to resolve the said event.

III -An authorisation derogating from I of this article may, in accordance with the conditions laid down in article L. 6122-2, be granted or renewed on an exceptional basis when, after analysing the needs of the population, access to other sites providing the healthcare activity imposes excessive journey times on a significant proportion of the population in the health region.

IV – By way of derogation, for the “interventional rhythmology” modality, grades C and D, and for sites carrying out exclusively paediatric activity, authorisation may be granted without a minimum activity requirement.

On these sites, the participation of an interventional rhythmologist from a site authorised for this modality and meeting the minimum activity conditions is required to perform interventional rhythmology procedures.

Article R6123-133-2

I.-L’autorisation de pratiquer l’activité interventionnelle sous imagerie médicale en cardiologie ne peut être accordée, maintenue ou renouvelée que si le titulaire de l’autorisation respecte, par site géographique autorisé, une activité minimale annuelle fixée, en tenant compte, le cas échéant, de la nature des actes, par arrêté du ministre en charge de la santé.

Dans le cadre d’une création, l’activité minimale annuelle est prévisionnelle pour la première année.

L’activité annuelle est établie par référence à certains actes des modalités mentionnées à l’article R. 6123-129.

II.-En cas de survenance d’un évènement exceptionnel et temporaire entraînant une baisse significative de l’activité, le directeur général de l’agence régionale de santé peut, sur demande expresse du titulaire, sursoir à l’application du I du présent article pour une durée maximale d’une année et dès lors que le titulaire a pris des engagements pour résoudre ledit évènement.

III.-Une autorisation dérogeant au I du présent article peut, dans les conditions prévues à l’article L. 6122-2, être accordée ou renouvelée à titre exceptionnel lorsque, après analyse des besoins de la population, l’accès aux autres sites pratiquant l’activité de soins impose des temps de trajet excessifs à une partie significative de la population du territoire de santé.

IV.-A titre dérogatoire, pour la modalité “ rythmologie interventionnelle ”, mentions C et D, et pour les sites réalisant exclusivement une activité pédiatrique, l’autorisation peut être accordée sans condition d’activité minimale.

Sur ces sites, la participation d’un rythmologue interventionnel d’un site autorisé à cette modalité et respectant les conditions d’activité minimale est requise pour la réalisation des actes de rythmologie interventionnelle.
