Article R621-37 of the French Monetary and Financial Code

When the Secretary General proposes that the Board implement the procedure provided for in II of Article L. 621-14, he shall first inform the person concerned, by registered letter with acknowledgement of receipt, by hand-delivery against receipt or by bailiff’s deed or by any other means that enables the date of receipt to be ascertained, of the practices that appear to him to be likely to be contrary to legislative or regulatory provisions and likely to produce one of the effects mentioned in II of the aforementioned Article L. 621-14. It shall specify that it has a period of at least three working days in which to make its observations known in writing.

Before taking a decision, the Board shall take note of any comments made by the person concerned.

Lorsque le secrétaire général propose au collège de mettre en œuvre la procédure prévue au II de l’article L. 621-14, il indique au préalable à la personne concernée par lettre recommandée avec demande d’avis de réception, remise en main propre contre récépissé ou acte d’huissier ou par tout autre moyen permettant de s’assurer de sa date de réception, les pratiques qui lui paraissent susceptibles d’être contraires aux dispositions législatives ou réglementaires et de nature à produire l’un des effets mentionnés au II de l’article L. 621-14 susmentionné. Il lui précise qu’elle dispose d’un délai qu’il fixe à trois jours ouvrés au moins pour faire connaître par écrit ses observations.

Avant de statuer, le collège prend connaissance des observations formulées, le cas échéant, par la personne concernée.
