Article R811-28 of the French Commercial code

Unless the knowledge they have acquired in the course of their professional experience is such as to make such verification unnecessary, the persons mentioned in article R. 811-27 shall appear before the jury provided for in Article R. 811-10 an examination to test their knowledge, organised by the National Council, the syllabus and procedures for which are set by order of the Minister of Justice:

1° When their training covers subjects that are substantially different from those included in the syllabus for the qualifications and diplomas mentioned in articles R. 811-7 and R. 811-8 and the professional training examination mentioned in R. 811-9 ;

2° Or where one or more of the professional activities the pursuit of which is subject to possession of these diplomas and this examination are not regulated in the Member State of origin or the Member State from which the foreign national comes, or are regulated in a different way, and this difference is characterised by specific training required in the host Member State covering subjects substantially different from those covered by the diploma to which the applicant refers.

Sauf si les connaissances qu’elles ont acquises au cours de leur expérience professionnelle sont de nature à rendre cette vérification inutile, les personnes mentionnées à l’article R. 811-27 subissent devant le jury prévu à l’article R. 811-10 un examen de contrôle des connaissances, organisé par le Conseil national, dont le programme et les modalités sont fixés par arrêté du garde des sceaux, ministre de la justice :

1° Lorsque leur formation porte sur des matières substantiellement différentes de celles qui figurent au programme des titres et diplômes mentionnés aux articles R. 811-7 et R. 811-8 et de l’examen de stage professionnel mentionné au R. 811-9 ;

2° Ou lorsqu’une ou plusieurs des activités professionnelles dont l’exercice est subordonné à la possession de ces diplômes et de cet examen ne sont pas réglementées dans l’Etat membre d’origine ou de provenance ou sont réglementées de manière différente et que cette différence est caractérisée par une formation spécifique requise dans l’Etat membre d’accueil portant sur des matières substantiellement différentes de celles couvertes par le diplôme dont le demandeur fait état.
