When a person mentioned in III of article L. 812-2 is unable to carry out his duties due to a suspension or a ban imposed under the conditions provided for in 3° and 4° of II of Article L. 814-10-2, the Public Prosecutor at the judicial court within whose jurisdiction this person has his professional domicile shall request the president of the judicial court, ruling on a motion, to appoint a provisional administrator without delay to carry out the legal mandates entrusted to the prevented professional as well as the acts necessary for the management of these mandates. The administrator is chosen, as the case may be, from among bailiffs or auctioneers.
The Government Commissioner at the National Commission shall request the appointed provisional administrator to proceed with informing the presidents of the courts that have granted mandates to the person mentioned in III of Article L. 812-2.
The provisions relating to the remuneration of the provisional administrator set out in article R. 811-59 are applicable.
