Title I: Scope and implementing provisions

Subject to the exceptions provided for in Article L. 4111-4, the provisions of this part apply to private-law employers and workers. For the establishments and groupings mentioned in 1° to 3° of article L. 4111-1, the provisions of this part may be adapted, by decree adopted, except in the case of specific provisions, by the Council of State, taking into account the particular characteristics of some of these establishments and the existing staff representation bodies. These adaptations ensure the same guarantees for employees.

The provisions of this part may be supplemented or adapted by decree to take account of the specific characteristics of companies and establishments operating in the mining, quarrying and related industries.

For the purposes of this Part, workers are employees, including temporary employees, and trainees, as well as any person placed in any capacity whatsoever under the authority of the employer.
