The fines provided for in this Title shall be imposed and recovered by the competent administrative authority under the conditions defined in Articles L. 8115-4, L. 8115-5 and L. 8115-7, on the basis of a report by the labour inspection officer referred to in Article L. 8112-1. The decision of the administrative authority may be contested in accordance with article L. 8115-6.
The administrative authority shall inform the Social and Economic Committee of the fines it imposes on the employer pursuant to this Title.
Failure by the employer to comply with the decisions taken by the labour inspector mentioned in Article L. 8112-1 in application of Articles L. 4731-1 or L. 4731-2 is punishable by a fine of up to 10,000 euros per worker concerned by the offence.
Failure by the employer to comply with requests for checks, measurements or analyses made by the Labour Inspectorate monitoring officer referred to in Article L. 8112-1 in application of Article L. 4722-1 and the regulatory provisions made for the application of the same Article, is punishable by a maximum fine of 10,000 euros.
Failure to comply with the decisions taken by the labour inspection officer mentioned in article L. 8112-1 pursuant to article L. 4733-2 or article L. 4733-3 is punishable by a fine of up to 10,000 euros per young person concerned.
Employing a worker under the age of eighteen in one or more of the prohibited activities provided for in Article L. 4153-8 and the regulatory provisions adopted for its application, or in regulated activities provided for in Article L. 4153-9, in disregard of the conditions set out in that same article and the regulatory provisions adopted for its application, is punishable by a fine of 2,000 euros per worker concerned.
Failure by the client, project owner or owner to comply with the obligations set out in article L. 4412-2 and the regulatory provisions adopted for its application is punishable by a maximum fine of €9,000.
As an exception to the first paragraph of Article L. 4751-1, the fines provided for in this chapter shall be imposed and recovered by the competent market surveillance authority, under the conditions defined in Articles L. 8115-4, L. 8115-5, with the exception of its third paragraph, L. 8115-6 and L. 8115-7, on the report of one of the officers mentioned in Articles L. 4311-6 or L. 4314-1.
Article L. 4751-2 does not apply to this chapter.
I.-A fine of up to €50,000 shall be imposed if an economic operator within the meaning of Article 3 of Regulation (EU) 2019/1020 of the European Parliament and of the Council of 20 June 2019 on market surveillance and product conformity and amending Directive 2004/42/EC and Regulations (EC) No 765/2008 and (EU) No 305/2011 fails to comply with a measure taken pursuant to Article L. 4314-2 of this Code or…
