Section 2: Procedures for refusing blood collection

The request to consult the register is made by the director of the health establishment in which the removal is planned or, failing this, by another official of the establishment expressly authorised for this purpose by the director. The request must be accompanied by a copy of the death certificate provided for in article R. 1232-3.

The response to the request to query the register is sent by an official of the Agence de la biomédecine expressly authorised for this purpose by the Director General of this establishment.

The Director General of the Agence de la biomédecine shall take all necessary measures to guarantee the security and confidentiality of all nominative information contained in the register, in accordance with the provisions of Act no. 78-17 of 6 January 1978 relating to information technology, files and civil liberties. The Director General of the Agence de la biomédecine, after obtaining the opinion of the Board of Directors, sends the Minister for Health an annual report on the activity and operation of the automated national register of refusals to consent to the removal of organs.
