Section 4: National public health establishments receiving prisoners or persons placed in secure detention.

The Director of Prison Administration, the Director of General Administration and Equipment at the Ministry of Justice, the Director General of Healthcare and the Director General of Health may attend or be represented at meetings of the Board of Directors in an advisory capacity.

By way of derogation from article L. 6144-4, the Technical Committee of the establishment comprises, on the one hand, the Chairman of the Board of Directors, the Director of the Prison Administration or his representative, the Director General of Healthcare or his representative, the Director of the establishment and, on the other hand, four representatives of the establishment’s staff covered by Title IV of the General Statute for Civil Servants….

The Director shall determine the composition of the Committee.

The Committee is chaired by the Chairman of the institution’s Board of Directors. It elects a Vice-Chairman from among its members.

If, before the expiry of his term of office, one of the full members is no longer able, for whatever reason, to carry out his duties, his alternate is appointed in his place until the renewal of the establishment’s Technical Committee. The Committee shall be convened by its Chairman; it shall be convened at the written request of the Director or of at least one third of the full members. In the latter case, the meeting must be convened within a maximum of eight days. In any event, the Committee shall meet at least twice a year.

The secretariat of the Committee is provided by the Director of the establishment. Minutes are taken after each meeting.

Committee meetings are not open to the public. The Committee may decide to hear any competent person on the issues on the agenda.

The committee issues opinions or wishes by a majority of the members present. In the event of a tie, the Chairman has the casting vote.
