Chapter VI: Individual monitoring of workers' health

Article R4426-1 of the French Labour Code

After consulting the occupational physician, the employer draws up a list of workers exposed to group 3 or 4 biological agents. The list shall indicate the type of work performed and, where possible, the biological agent to which the workers are exposed, as well as data relating to exposure, accidents and incidents. Article R4426-2 of the French Labour Code

The list of exposed workers is kept for at least ten years after the end of exposure. However, where biological agents are likely to cause illnesses with a long incubation period, the list is kept for as long as pathological manifestations are possible.

The medical file is established following the examinations and visits provided for in article R. 4426-7. When biological agents are likely to cause illnesses with a long incubation period, the medical record is kept for a period of up to forty years after known exposure has ceased.

Article R4426-10 of the French Labour Code

When the company disappears or when the worker changes company, the medical file is sent either to the occupational physician of the new company, or to the occupational health inspector, who is responsible for sending it, where appropriate, at the worker’s request, to the occupational physician now responsible. At the worker’s request, the medical file is sent to the doctor designated by the worker.
