Within the first eight days of each month, the employer must send the DARES (Direction de l’animation de la recherche, des études et des statistiques) a statement of the employment contracts concluded or terminated during the previous month. This provision does not apply to fixed-term employment contracts concluded for a maximum non-renewable period of one month.
The monthly statement of employment contracts contains the following information: 1° The name and address of the employer; 2° The nature of the company’s activity; 3° The surname, first names, nationality, date of birth, sex, job and qualifications of the employees whose employment contracts have been concluded or terminated; 4° The effective date of the employment contracts or their termination with, in the event of redundancy for economic reasons, an…
At the express request of the departments responsible for employment control, the employer shall provide the addresses of employees whose employment contracts have been concluded or terminated, as referred to in 3° of article D. 1221-30.
The prior declaration provided for in Article L. 1221-17 shall be made by the employer. In the case provided for in 2° of the same article, the declaration is made by the new employer, by registered letter addressed to the Labour Inspectorate. The receipt for the letter is presented by the employer at the request of the Labour Inspectorate during its first visit.
The prior declaration must specify: 1° Which of the cases provided for in article L. 1221-17 it covers; 2° The name and address of the declarant; 3° The location of the establishment; 4° The exact nature of the industries or businesses carried out.
