Chapter IV: Referral to the civil or administrative courts

Following the findings made on the basis of articles L. 511-5 à L. 511-7, the administrative authority responsible for competition and consumer affairs may apply to the civil court or, if appropriate, to the administrative court: 1° to order, where appropriate subject to a fine, the removal of an unlawful, prohibited or unfair term inserted by a professional in any contract or type of contract offered or intended for consumers…

The administrative authority responsible for competition and consumer affairs may, after notifying the public prosecutor, ask the civil court to order, where appropriate subject to a fine, any measure likely to put an end to the breaches of contractual obligations or unlawful conduct referred to in Articles L. 511-5, L. 511-6 and L. 511-7.

In the event of an infringement or failure to comply with the provisions mentioned in articles L. 511-5, L. 511-6 et L. 511-7 or in Book IV, the administrative authority responsible for competition and consumer affairs may ask the judicial authority to prescribe in summary proceedings or on application, under the conditions provided for in the 8 of the I of article 6 of law no. 2004-575 of 21 June…

When the administrative authority responsible for competition and consumer affairs asks the civil court to order one of the measures mentioned in this chapter, it may also ask the court seised to order a civil fine when this is provided for by the provisions mentioned in Articles L. 511-5 à L. 511-7 or in Book IV.
