Section 2: Provisions specific to vaping products containing nicotine

Disposable electronic vaping devices, refill bottles and single-use cartridges containing nicotine contain only high-purity ingredients, except for technically unavoidable traces in the manufacturing process. With the exception of nicotine, only ingredients which, whether heated or not, pose no risk to human health are used in vaping products containing nicotine. The maximum nicotine content of these products is set by order of the Minister for Health. Under normal conditions of use, electronic vaping devices deliver nicotine consistently.

Vaping products containing nicotine include a safety device, the characteristics of which are determined by order of the Minister for Health.

Six months before placing nicotine-containing vaping products on the market, manufacturers and importers submit a notification file for each brand and type of product to the public body designated by order. This file includes information on those responsible for placing the product on the market, its composition, emissions, toxicological data on ingredients and emissions, components and manufacturing process.

Manufacturers and importers of nicotine-containing vaping products declare annually for the past year to the public establishment mentioned in article L. 3513-10 data on their sales by brand and type, as well as summaries of the market studies they carry out.

Manufacturers, importers and distributors of nicotine-containing vaping products shall establish and maintain a system for collecting information on any suspected adverse effects of these products on human health. When the public establishment mentioned in article L. 3513-10 observes or has reasonable grounds to believe that a vaping product containing nicotine or a given type of product could present a serious risk to human health, it immediately informs the Ministry of Health, proposing appropriate provisional measures.
