Section 12: Maintenance and repair of household electrical or electronic equipment

For the application of article L. 224-109, parts from the circular economy mean components and elements from a preparation operation with a view to their re-use within the meaning of the provisions of articles L. 541-1-1 and L. 541-4-3du code de l’environnement.

The obligation set out in article L. 224-109 is not applicable when parts from the circular economy are not available within the timeframe compatible with the date or timeframe for the provision of the maintenance or repair service determined under the conditions provided for in Article L. 216-1.

The obligation set out in article L. 224-109 applies to the following categories of equipment and spare parts:

For the purposes of this section, durable medium means: a durable medium within the meaning of 8° of the introductory article.

At the entrance to the premises where the public is received to make a request for maintenance or repair of equipment mentioned in article R. 224-32, the professional referred to in article L. 224-109, informs the consumer of the possibility of opting, during the proposed maintenance or repair service, for the use of parts from the circular economy, by means of a clear, visible and externally legible display. In the context of an offer to provide maintenance or repair services for equipment requiring the use of a part falling within a category mentioned in article R. 224-32, the trader, before the consumer accepts the offer, allows the consumer to opt for the use of a corresponding part from the circular economy. When, several parts from the circular economy can be offered to replace the same defective part, in particular when the choice of one of them has consequences on the repair or maintenance time or price, the possibility of choosing between the different parts and options is clearly presented to the consumer. He shall specify his choice on a durable medium.

The trader shall keep, where appropriate in dematerialised form, a duplicate copy of the documents communicated to the consumer for a period of two years.
