Title VI: OVERSEAS PROVISIONS

To enter the French Southern and Antarctic Lands, any foreigner must be in possession of the documents and visas required by the international conventions and regulations in force. Where a visa is required, it shall be issued with the agreement of the High Administrator of the French Southern and Antarctic Lands.The provisions of this chapter shall not apply to diplomatic agents and career consuls.

The agreement referred to in Article L. 367-1 must be applied for at least one month before the date of arrival in France. The diplomatic or consular authority may request a reduction in this period in emergency situations.

In the event that a foreigner disembarks in the Southern and Antarctic Lands without being in possession of the documents and visas mentioned in article L. 367-1, the district chief may refuse admission to the territory; in this case, he/she will invite the person to leave the territory as soon as possible.

When the admission of a foreigner is refused in the French Southern and Antarctic Lands, the person who conveyed him is obliged to return him, at the request of the High Administrator, without delay and at his own expense, to the point where he began to use that person’s means of transport, or, if this is impossible, to the State which issued the travel document with which he travelled, or…

If a foreign national who has not been admitted to enter the French Southern and Antarctic Lands has not been able to disembark in a foreign territory under the conditions provided for in Article L. 367-4, the on-board authorities are responsible for handing him/her over to the border control authorities at the next stopover in France.
