Article 728-3 of the French Code of Criminal Procedure

On arrival on French soil, the detained offender is presented to the public prosecutor of the place of arrival, who conducts an identity examination and draws up a report. However, if the examination cannot be conducted immediately, the convicted person is taken to the prison where he may not be held for more than twenty-four hours. On expiry of this period, he will be brought before the public prosecutor by the head of the prison.

In the light of the documents showing the agreement of the States to the transfer and the consent of the person concerned, as well as the original or a copy of the foreign sentencing judgment, accompanied, where applicable, by an official translation, the public prosecutor will request the immediate imprisonment of the sentenced person.

Dès son arrivée sur le sol français, le condamné détenu est présenté au procureur de la République du lieu d’arrivée, qui procède à son interrogatoire d’identité et en dresse procès-verbal. Toutefois, si l’interrogatoire ne peut être immédiat, le condamné est conduit à la maison d’arrêt où il ne peut être détenu plus de vingt-quatre heures. A l’expiration de ce délai, il est conduit d’office devant le procureur de la République, par les soins du chef d’établissement.

Au vu des pièces constatant l’accord des Etats sur le transfèrement et le consentement de l’intéressé ainsi que de l’original ou d’une expédition du jugement étranger de condamnation, accompagnés, le cas échéant, d’une traduction officielle, le procureur de la République requiert l’incarcération immédiate du condamné.
