Article 728-44 of the French Code of Criminal Procedure

If the sentencing decision can be recognised as enforceable in France, the public prosecutor will assess whether the custodial sentence or detention order should be adjusted.

Where the length of the custodial sentence or detention order handed down is longer than that which could legally have been handed down by a French court for the same offence, the public prosecutor will propose that it be reduced to the legal maximum incurred under French law for the corresponding offence. Where the sentence relates to several offences, the prosecutor will refer to the legal maximum for the most severely punished offence.

Where, by its nature, the custodial sentence or detention order is incompatible with French law, the Public Prosecutor shall propose substituting the custodial sentence or detention order incurred under that law, unless such substitution would have the effect of aggravating the sentence.

Si la décision de condamnation peut être reconnue comme étant exécutoire en France, le procureur de la République apprécie s’il y a lieu de procéder à l’adaptation de la peine ou de la mesure de sûreté privative de liberté prononcée.

Lorsque la durée de la peine ou de la mesure de sûreté privative de liberté prononcée est supérieure à celle qui aurait pu être légalement prononcée par une juridiction française pour les mêmes faits, le procureur de la République propose de la réduire au maximum légal encouru selon la loi française pour l’infraction correspondante. Lorsque la condamnation porte sur plusieurs infractions, il se réfère au maximum légal encouru pour l’infraction correspondante la plus sévèrement sanctionnée.

Lorsque, par sa nature, la peine ou la mesure de sûreté privative de liberté est incompatible avec la loi française, le procureur de la République propose de lui substituer la peine ou la mesure de sûreté privative de liberté encourue selon cette loi, à moins que cette substitution n’ait pour conséquence d’aggraver la condamnation.
