If the sentencing decision can be recognised as enforceable in France, the public prosecutor will assess whether the custodial sentence or detention order should be adjusted.
Where the length of the custodial sentence or detention order handed down is longer than that which could legally have been handed down by a French court for the same offence, the public prosecutor will propose that it be reduced to the legal maximum incurred under French law for the corresponding offence. Where the sentence relates to several offences, the prosecutor will refer to the legal maximum for the most severely punished offence.
Where, by its nature, the custodial sentence or detention order is incompatible with French law, the Public Prosecutor shall propose substituting the custodial sentence or detention order incurred under that law, unless such substitution would have the effect of aggravating the sentence.
