When the sentenced person is on French territory and the competent authority of the sentencing State requests that, pending the decision on the recognition and enforcement of the sentencing decision, the sentenced person be subject to provisional arrest or any other measure designed to ensure that he or she remains on French territory, the public prosecutor, if he or she considers that the person does not present sufficient guarantees of representation, shall request that he or she be apprehended and brought before him or her within twenty-four hours. During this period, articles 63-2 and 63-3 shall apply.
In the event that the request referred to in the first paragraph of this Article has been made by the competent authority of the convicting State before the latter has forwarded the sentencing decision and the certificate, the person may only be apprehended pursuant to the same first paragraph if the competent authority of the convicting State has provided the public prosecutor with the information provided for in 1° to 6° of l’article 728-12.
