Article A113-1 of the French Insurance Code

Insurance contracts relating to the operations mentioned in 5° of article L. 310-1 and with a term of more than three years must include the following clause:

The duration of this contract shall be stated in very clear characters immediately above the policyholder’s signature.

Failing this, the policyholder may, notwithstanding any clause to the contrary, terminate the contract without compensation each year on the anniversary of the date on which it takes effect, subject to at least one month’s notice.

Les contrats d’assurance afférents aux opérations mentionnées au 5° de l’article L. 310-1 et dont la durée est supérieure à trois ans doivent comporter la clause suivante :

La durée du présent contrat est rappelée par une mention en caractères très apparents figurant juste au-dessus de la signature du souscripteur.

A défaut de cette mention, le souscripteur peut, nonobstant toute clause contraire, résilier le contrat sans indemnité, chaque année à la date anniversaire de sa prise d’effet, moyennant préavis d’un mois au moins.
