Article A143-4 of the French Insurance Code

The notice referred to in the first paragraph of article L. 143-2-2 contains the following information

1° The name, country of origin and name of the authority responsible for supervising the supplementary occupational pension fund, the institution for occupational retirement provision or the insurance company guaranteeing the contract;

2° The corporate name and contact details of the subscriber;

3° The essential terms of the contract, in particular the guarantees offered to members and the procedures for converting rights into retirement benefits;

4° The conditions under which the contract may be amended and the consequences of failure to comply with these conditions;

5° Information on the investment profile;

6° The nature of the financial risks taken by members and beneficiaries;

7° A description of the guarantees offered by the contract to members, without omitting the limits of the guarantees offered and the elements not guaranteed;

8° The level of benefits or, where no guarantees are provided under the pension scheme, a statement to that effect as well as the method of evaluating the amount of benefits before they are paid;

9° The conditions under which members participate in technical and financial profits;

10° The procedures for protecting accumulated rights and for adjusting benefits, where applicable;

11° Where rights may be expressed in units of account or where members have the ability to arbitrate between funds, information on the past performance of investments linked to the pension scheme over a minimum period of five years, or over the entire period of operation of the scheme if this is less than five years;

12° The structure of costs borne by members and beneficiaries, for schemes which do not provide for a given level of benefits;

13° The options available to members and beneficiaries to obtain payment of their retirement benefits;

14° In accordance with II of Article D. 132-7, the conditions under which members have the ability to transfer their pension rights to another organisation;

15° Information on whether and how environmental, climate, social and corporate governance factors are taken into account in the investment strategy;

16° The list and means of access to additional information, in particular information on the investment vehicles and the financial situation of the organisation guaranteeing the contract.

In the case of contracts providing for certain rights to be expressed in units of account or for switches to be made to these vehicles, members are informed of all the vehicles available and, where applicable, of the default investment option and the conditions under which a given member is assigned to an investment option.

La notice mentionnée au premier alinéa de l’article L. 143-2-2 contient les informations suivantes :

1° Le nom, le pays d’origine et le nom de l’autorité en charge du contrôle du fonds de retraite professionnelle supplémentaire, de l’institution de retraite professionnelle ou de l’entreprise d’assurance garantissant le contrat ;

2° La dénomination sociale et les coordonnées du souscripteur ;

3° Les stipulations essentielles du contrat, notamment les garanties offertes aux affiliés et les modalités de conversion des droits en prestation de retraite ;

4° Les conditions dans lesquelles le contrat peut être modifié et les conséquences en cas de non-respect de ces conditions ;

5° Des informations sur le profil d’investissement ;

6° La nature des risques financiers pris par les affiliés et les bénéficiaires ;

7° Une description des garanties offertes par le contrat aux affiliés, sans omettre les limites des garanties offertes et les éléments non garantis ;

8° Le niveau des prestations ou, lorsqu’aucune garantie n’est prévue au titre du régime de retraite, une déclaration à cet effet ainsi que la méthode d’évaluation du montant des prestations avant leur versement ;

9° Les conditions dans lesquelles les affiliés participent aux bénéfices techniques et financiers ;

10° Les modalités de protection des droits accumulés et de modulation des prestations, le cas échéant ;

11° Lorsque les droits peuvent être exprimés en unités de compte ou que les affiliés disposent d’une capacité d’arbitrage entre des supports, les informations relatives aux performances passées des investissements liés au régime de retraite sur une période minimale de cinq ans, ou sur toute la période de fonctionnement du régime si elle est inférieure à cinq ans ;

12° La structure des coûts supportés par les affiliés et les bénéficiaires, pour les régimes qui ne prévoient pas un niveau donné de prestations ;

13° Les options à la disposition des affiliés et des bénéficiaires pour obtenir le versement de leurs prestations de retraite ;

14° Conformément au II de l’article D. 132-7, les conditions dans lesquelles l’affilié dispose d’une capacité de transférer ses droits à la retraite à un autre organisme ;

15° Des informations indiquant si et de quelle manière les facteurs environnementaux, climatiques, sociaux et de gouvernance d’entreprise sont pris en considération dans la stratégie d’investissement ;

16° La liste et le moyen d’accès à des informations complémentaires, notamment des informations sur les supports d’investissement et la situation financière de l’organisme garantissant le contrat.

Pour les contrats prévoyant que certains droits puissent être exprimés en unités de compte ou que des arbitrages puissent être réalisés vers ces supports, les affiliés sont informés de l’ensemble des supports disponibles et, le cas échéant, de l’option d’investissement par défaut et des conditions de rattachement d’un affilié donné à une option d’investissement.
