Where, in accordance with the provisions of the third paragraph of I of Article R. 49-1 or the last paragraph of article R. 49-10, the offence is recorded by the ticketing officer under conditions that do not allow the ticket and payment card to be issued immediately, in particular because the official report is drawn up using the device provided for in Article A. 37-19, the following documents shall be sent by post to the offender’s home address or, where the offender’s identity cannot be established, to the home address of the holder of the registration certificate:
-a notice of offence;
-a payment notice;
a request for exoneration form on a separate sheet, where the information relating to the procedures for contesting and appealing is not included on the notice of offence.
The characteristics of these documents are set out in the articles A. 37-16 to A. 37-18.
When the official report recording the offence is drawn up in the offender’s absence, a document informing him that he will receive a notice of the fine at his home address may be left on the vehicle. Failure to leave this document, however, does not constitute grounds for invalidating the procedure.
