Article D115-1 of the French Code of Criminal Procedure

Sentence reductions apply to all custodial sentences, when the conviction has become final, including those managed under the semi-liberty, work release or electronically supervised home detention scheme.

They do not, however, apply to imprisonment resulting from:

1° Withdrawal of a sentence reduction ordered pursuant to articles 721,721-2 and 723-35;

2° De la contrainte judiciaire.

Les réductions de peine s’appliquent à toutes les peines privatives de liberté, lorsque la condamnation est devenue définitive, y compris celles qui sont aménagées sous le régime de la semi-liberté, du placement à l’extérieur ou de la détention à domicile sous surveillance électronique.


Elles ne s’appliquent cependant pas à l’emprisonnement résultant :


1° Du retrait d’une réduction de peine ordonné en application des articles 721,721-2 et 723-35 ;


2° De la contrainte judiciaire.
