Article D1271-2 of the French Labour Code

Public persons and private persons entrusted with a public service mission who finance the special payment vouchers mentioned in B of article L. 1271-1 for service users may, with the agreement of the beneficiary or, if this cannot be obtained, with the agreement of the beneficiary’s legal representative, decide that the special payment voucher is payable to a named association or service company, where the beneficiary’s inability to choose a service provider in his or her own home is established.

Les personnes publiques ainsi que les personnes privées chargées d’une mission de service public qui financent des titres spéciaux de paiement mentionnés au B de l’article L. 1271-1 pour les usagers du service peuvent, avec l’accord du bénéficiaire ou, si celui-ci ne peut être recueilli, avec l’accord de son représentant légal, décider que le titre spécial de paiement est payable à une association ou entreprise de service dénommée, dès lors que l’incapacité du bénéficiaire à faire le choix d’un intervenant à son domicile est établie.
