Mayors, deputy mayors, deputy mayors in associated communes, deputy mayors in delegated communes, presidents and vice-presidents of urban communities, compulsorily affiliated to the scheme of the institution for the complementary retirement of non-tenured employees of the State and public authorities (I.R.C.A.N.T.E.C.) from 1 January 1973 or who have been affiliated since that date may, at their request, have service completed before 1 January 1973 and for which they received a function allowance taken into account.
To this end, they must make a payment equal to the amount of the contributions that would have been paid under the supplementary pension scheme for non-tenured employees of the State and public authorities or the schemes that preceded it, if these schemes had been applied to them at the times when these services were completed; the municipality must then pay its share of the contributions.
The request for validation must be made within a period of two years from the date of affiliation of the person concerned.
Validation requested after the expiry of the two-year period provided for in the previous paragraph is subject to the payment by the person concerned of his contribution increased in the same proportion as the reference salary since the date of foreclosure.
Retroactive payments payable by the beneficiary must be made in full, on pain of forfeiture of the right to validation, before the expiry of a period running from the notification made to the person concerned and calculated at the rate of one quarter per full year of service to be validated.
