Article D2223-100 of the French General Code of Local Authorities

A crematorium comprises a public area reserved for families and a technical area reserved for professionals.

It is designed in accordance with the provisions of Article L. 112-2 of the Construction and Housing Code.

The public area of the crematorium reserved for the reception of families complies with the regulations applicable to establishments open to the public, in particular the provisions of the fire safety regulations.

The technical area and the public area of the crematorium comply with the regulations applicable to establishments open to the public, in particular the provisions of the fire safety regulations.
The technical part and the public part of the crematorium in which professionals carry out their activities comply with the regulatory provisions of Part IV of the French Labour Code, in particular with regard to:

The use of the crematorium’s premises, in particular with regard to
1° The use of workplaces, including fire prevention;

2° The design and use of work equipment;

3° The prevention of specific risks.

The technical characteristics relating to the public and technical parts of a crematorium are determined by joint order of the minister responsible for local authorities and the minister responsible for health.

Un crématorium comprend une partie publique réservée à l’accueil des familles et une partie technique réservée aux professionnels.


Il est conçu conformément aux dispositions de l’article L. 112-2 du code de la construction et de l’habitation.


La partie publique du crématorium réservée à l’accueil des familles est conforme à la réglementation applicable aux établissements recevant du public, notamment aux dispositions du règlement de sécurité contre l’incendie.


La partie technique et la partie publique du crématorium dans laquelle des professionnels sont amenés à exercer leur activité sont conformes aux dispositions réglementaires de la quatrième partie du code du travail, notamment en ce qui concerne :


1° L’utilisation des lieux de travail, y compris en matière de prévention incendie ;


2° La conception et l’utilisation des équipements de travail ;


3° La prévention des risques particuliers.


Les caractéristiques techniques relatives aux parties publiques et techniques d’un crématorium sont déterminées par arrêté conjoint du ministre chargé des collectivités territoriales et du ministre chargé de la santé.
