Article D249 of the French Code of Criminal Procedure

Persons wishing to be authorised to sit on the Disciplinary Committee as an assessor shall send a letter of application to the president of the judicial court with territorial jurisdiction, specifying the address of the prisons in which they wish to work.

They may also send their application to the head of the prison, who will forward it without delay to the president of the judicial court.

Silence kept for two months by the president of the judicial court on an application for authorisation shall constitute a decision to reject.

The authorisation decision shall result in registration on the list provided for in third paragraph of article R. 234-6 of the Penitentiary Code.

This list is communicated to the head of the penitentiary establishment on the occasion of each new registration and at least once a year.

Les personnes qui souhaitent être habilitées à participer à la commission de discipline en qualité d’assesseur adressent au président du tribunal judiciaire territorialement compétent une lettre de candidature précisant l’adresse des établissements pénitentiaires au sein desquels ils souhaitent intervenir.

Elles peuvent également adresser leur candidature au chef de l’établissement pénitentiaire qui la communique sans délai au président du tribunal judiciaire.

Le silence gardé pendant deux mois par le président du tribunal judiciaire sur une demande d’habilitation vaut décision de rejet.

La décision d’habilitation entraîne l’inscription sur la liste prévue au troisième alinéa de l’article R. 234-6 du code pénitentiaire.

Cette liste est communiquée au chef de l’établissement pénitentiaire à l’occasion de chaque nouvelle inscription et au moins une fois par an.
