Article D6323-21-4 of the French Labour Code

I.-The management costs of the commissions may not exceed a ceiling determined in the agreement on objectives and resources.

These costs are defined on the basis of requests submitted by the joint inter-professional committee and the objectives agreed with the regional prefect.

II – The ceiling on management fees mentioned in I is between a minimum and a maximum determined as a percentage of the sums collected in respect of the funds mentioned in 5° of article L. 6123-5. These minimum and maximum amounts are set by order of the Minister responsible for vocational training.

III – In the event that the agreement on objectives and resources is not concluded, the costs mentioned in I may not exceed the minimum mentioned in II.

I.-Les frais de gestion des commissions ne peuvent excéder un plafond déterminé dans la convention d’objectifs et de moyens.


Ces frais sont définis en fonction des demandes présentées par la commission paritaire interprofessionnelle et des objectifs fixés avec le préfet de région.


II.-Le plafond des frais de gestion mentionné au I est compris entre un minimum et un maximum déterminés en pourcentage des sommes perçues au titre des fonds mentionnés au 5° de l’article L. 6123-5. Ce minimum et ce maximum sont fixés par arrêté du ministre chargé de la formation professionnelle.


III.-En cas d’absence de conclusion de la convention d’objectifs et de moyens, les frais mentionnés au I ne peuvent excéder le minimum mentionné au II.
