Article D6325-31 of the French Labour Code

Hosting an employee in companies other than those employing him/her is subject to an agreement between the employer, the host companies and the employee.

The agreement specifies in particular

1° The title, diploma or vocational qualification certificate being prepared, the duration of the period of work experience and the nature of the tasks entrusted to the employee ;

2° The working hours and locations;

3° The arrangements for sharing the costs, remuneration and benefits associated with the employee’s employment between the employer and each host company;

4° The arrangements for sharing transport and accommodation costs between the employer and each host company;

5° The obligation for each host company to take out civil liability insurance.

L’accueil du salarié dans d’autres entreprises que celles qui l’emploie fait l’objet d’une convention conclue entre l’employeur, les entreprises d’accueil et le salarié.

La convention précise notamment :

1° Le titre, le diplôme ou le certificat de qualification professionnel préparé, la durée de la période d’accueil et la nature des tâches confiées au salarié ;

2° Les horaires et les lieux de travail ;

3° Les modalités de partage, entre l’employeur et chaque entreprise d’accueil, des charges, rémunérations et avantages liés à l’emploi du salarié ;

4° Les modalités de partage, entre l’employeur et chaque entreprise d’accueil, des frais de transport et d’hébergement ;

5° L’obligation pour chaque entreprise d’accueil de se garantir en matière de responsabilité civile.
