Prior to the conclusion of a contract of sale or provision of services, the trader shall ensure that the consumer has given his express consent to any additional payment over and above the price of the main subject matter of the contract.
In the event that the additional payment results from the consumer’s consent given by default, i.e. in the absence of express opposition on his part to paying options which he has not requested, the consumer may claim reimbursement of the sums paid in respect of this additional payment.
The provisions of this article apply to contracts for the supply of water, gas or electricity where they are not packaged in a delimited volume or in a specific quantity as well as to the supply of district heating and digital content not supplied on a physical medium.
