Article L1221-17 of the French Labour Code

In addition to the pre-employment declaration provided for in Article L. 1221-10, a pre-employment declaration must be made :

1° When an establishment, having ceased to employ staff for at least six months, proposes to employ staff again;

2° When an establishment employing staff changes operator;

3° When an establishment employing staff is transferred to another location or if it undergoes an extension or transformation resulting in a change in its industrial or commercial activities.

Outre la déclaration préalable à l’embauche prévue à l’article L. 1221-10, une déclaration préalable est effectuée :

1° Lorsqu’un établissement, ayant cessé d’employer du personnel pendant six mois au moins, se propose d’en employer à nouveau ;

2° Lorsqu’un établissement employant du personnel change d’exploitant ;

3° Lorsqu’un établissement employant du personnel est transféré dans un autre emplacement ou s’il fait l’objet d’extension ou de transformation entraînant une modification dans les activités industrielles et commerciales.
