In the event of an accident at an installation covered by Title I of Book V of the Environmental Code and damaging a large number of properties, the state of technological disaster is declared by a decision of the administrative authority which specifies the areas and the period of occurrence of the damage to which the provisions of this chapter apply.
The same provisions apply to accidents related to the transport of hazardous materials or caused by the installations mentioned in article L. 211-2 of the Mining Code.
This chapter does not apply to nuclear accidents as defined by the Convention on Third Party Liability in the Field of Nuclear Energy signed in Paris on 29 July 1960.
A decree of the Conseil d’Etat shall specify the conditions of application of this article.
