Article L1312-1 of the French Public Health Code

Subject to the provisions of articles L. 1324-1, L. 1337-1, L. 1337-1-1, L. 1338-4 and L. 1343-1, breaches of the provisions of the articles of this book, or of the regulations adopted for their application, and breaches of the provisions of the articles of Title I of Book V of the Construction and Housing Code relating to insalubrity are investigated and recorded by officers and agents of the judicial police, in accordance with the provisions of the Code of Criminal Procedure, as well as by the agents mentioned in articles L. 1421-1 and L. 1435-7 or agents of local authorities authorised and sworn in under conditions laid down by decree in the Conseil d’Etat. To this end, these officials and agents have the powers and prerogatives set out in articles L. 1421-2 and L. 1421-3 .

Official reports drawn up by the agents mentioned in articles L. 1421-1 and L. 1435-7 or by the agents of the local authorities mentioned in the previous paragraph in this area are authentic until proven otherwise.

Violations of the provisions of health regulations relating to the cleanliness of public roads and spaces may also be recorded by officers specially authorised to record violations of the provisions of the Highway Code concerning the stopping or parking of vehicles.

Article L1312-1

Sous réserve des dispositions des articles L. 1324-1, L. 1337-1, L. 1337-1-1, L. 1338-4 et L. 1343-1, les infractions aux prescriptions des articles du présent livre, ou des règlements pris pour leur application, et les infractions aux prescriptions des articles du titre Ier du livre V du code de la construction et de l’habitation en matière d’insalubrité sont recherchées et constatées par des officiers et agents de police judiciaire, conformément aux dispositions du code de procédure pénale, ainsi que par les agents mentionnés aux articles L. 1421-1 et L. 1435-7 ou des agents des collectivités territoriales habilités et assermentés dans des conditions fixées par décret en Conseil d’Etat. A cet effet, ces fonctionnaires et agents disposent des pouvoirs et prérogatives prévus aux articles L. 1421-2 et L. 1421-3.

Les procès-verbaux dressés par les agents mentionnés aux articles L. 1421-1 et L. 1435-7 ou des agents des collectivités territoriales mentionnés à l’alinéa précédent en ce domaine font foi jusqu’à preuve contraire.

Les contraventions aux dispositions des règlements sanitaires relatives à la propreté des voies et espaces publics peuvent être également relevées par les agents spécialement habilités à constater par procès-verbaux les contraventions aux dispositions du code de la route concernant l’arrêt ou le stationnement des véhicules.
