Article L1322-5 of the French Public Health Code

The works, activities, deposits or installations mentioned in article L. 1322-4 and undertaken, either by virtue of a regular authorisation, or after a prior declaration, may, at the request of the owner of the spring, be prohibited by the representative of the State in the department, if their observed result is to alter or diminish the spring.

The owner of the land is heard beforehand.

The order issued by the representative of the State in the département is provisionally enforceable, unless an appeal is made to the administrative court.

Article L1322-5

Les travaux, activités, dépôts ou installations mentionnés à l’article L. 1322-4 et entrepris, soit en vertu d’une autorisation régulière, soit après une déclaration préalable, peuvent, sur la demande du propriétaire de la source, être interdits par le représentant de l’Etat dans le département, si leur résultat constaté est d’altérer ou de diminuer la source.

Le propriétaire du terrain est préalablement entendu.

L’arrêté du représentant de l’Etat dans le département est exécutoire par provision, sauf recours au juge administratif.
