Article L1324-2 of the French Public Health Code

Infringements of the provisions of Chapters I and II of this Title and of the regulations adopted for their application are recorded in official reports, which are valid until proven otherwise.

Official reports are drawn up in duplicate, one copy being sent to the representative of the State in the département and the other to the public prosecutor. A copy is also given to the person concerned.

Les infractions aux dispositions des chapitres Ier et II du présent titre ainsi qu’aux règlements pris pour leur application sont constatées par des procès-verbaux qui font foi jusqu’à preuve du contraire.

Les procès-verbaux sont dressés en double exemplaire, dont l’un est adressé au représentant de l’Etat dans le département et l’autre au procureur de la République. Une copie en est également remise à l’intéressé.
