The following may be candidates for the employers’ college
1° Persons employing on their own behalf or on behalf of others one or more employees;
2° Where applicable, on the express mandate of these persons and if they are not themselves candidates, the collaborating spouses mentioned in article L. 121-4 of the Commercial Code for craftsmen, traders and self-employed professionals and in article L. 321-5 of the Rural and Maritime Fishing Code for farmers;
3° General partners, chairmen of boards of directors, general managers and directors, as well as managers who have a specific delegation of authority over a department or establishment of the company, established in writing, which enables them to be treated as an employer;
4° Persons who have ceased all activity and whose last professional activity fell within the categories mentioned in 1° or 3°.
For the persons referred to in 2°, the conditions laid down in article L. 1441-7 must be fulfilled in the person of the mandating artisan, trader, self-employed professional or head of a farm or agricultural business, and in that of his or her collaborating spouse acting as mandator. However, in the case of the latter, the condition of two years’ professional activity in the ten years preceding the candidacy, referred to in the said article, is replaced by an equivalent period of status as collaborating spouse, assessed on the opening date for the submission of candidacies, set by regulation.
