Article L1441-16 of the French Labour Code

The membership of candidate employees to the sections is determined with regard to the field of application of the collective labour agreement to which they belong, according to the distribution table mentioned in article L. 1423-1-1, with the exception of the persons mentioned in article L. 1441-14 and the professional and managerial staff mentioned in 3° of article L. 1441-12.

L’appartenance des salariés candidats aux sections est déterminée au regard du champ d’application de la convention ou de l’accord collectif de travail dont ils relèvent, selon le tableau de répartition mentionné à l’article L. 1423-1-1, à l’exception des personnes mentionnées à l’article L. 1441-14 et des cadres mentionnés au 3° de l’article L. 1441-12.
