Article L145-1 of the French Insurance Code

This chapter applies to compulsory group contracts covering death, physical injury, maternity, incapacity for work or invalidity. It also applies to optional group contracts covering these same risks, with the exception of those covered by order of the ministers responsible for the economy, social security and mutual insurance.

A group insurance contract under which the head of a company, referred to as the “employer”, takes out a contract with an insurance company for the benefit of his employees or one or more categories of employees to cover commitments or risks is referred to as a “compulsory group contract” when the employees concerned are obliged to take out the contract and as an “optional group contract” when the employees are not obliged to take out the contract.

A group insurance contract under which a legal entity takes out a collective contract with an insurance company for the benefit of its members, who are free to join, with a view to providing cover for commitments or risks is referred to as a “voluntary collective operation”.

For the application of the general provisions relating to group insurance under this code in the context of operations covered by this chapter, the reference to the policyholder is replaced by the reference to the employer or, where applicable, the legal entity, and the reference to the member is replaced by the reference to the employee or, where applicable, the member of the legal entity.

For the application of article L. 113-15, the reference to the policy is replaced by the reference to the collective contract.

For the application of articles L. 112-2, L. 112-3 and L. 113-2, the reference to the insured and the reference to the policyholder are replaced by the reference to the employer or, where applicable, the legal entity, with the exception of the fourth paragraph of article L. 112-3 and 2°, 3° and 4° of Article L. 113-2, for which the reference to the insured is replaced by a simultaneous reference to the employer and the employee or, where applicable, to the legal entity and the member of the legal entity.

For the application of article L. 113-11, the reference to the insured is replaced by the reference to the employee or, where applicable, to the member of the legal entity or to the beneficiary.

Article L145-1

Le présent chapitre s’applique aux contrats de groupe à adhésion obligatoire couvrant le risque décès, les risques portant atteinte à l’intégrité physique de la personne ou liés à la maternité, les risques d’incapacité de travail ou d’invalidité. Il s’applique également aux contrats de groupe à adhésion facultative couvrant ces mêmes risques, à l’exception de ceux visés par arrêté des ministres chargés de l’économie, de la sécurité sociale et de la mutualité.

Le contrat d’assurance de groupe par lequel un chef d’entreprise, dénommé “ l’employeur ”, souscrit auprès d’une entreprise d’assurance un contrat au profit de ses salariés ou d’une ou plusieurs catégories d’entre eux en vue d’assurer la couverture d’engagements ou de risques est dit “ opération collective à adhésion obligatoire ” lorsque les salariés concernés sont tenus d’adhérer au contrat et “ à adhésion facultative ” lorsque les salariés ne sont pas tenus d’adhérer au contrat.

Le contrat d’assurance de groupe par lequel une personne morale souscrit auprès d’une entreprise d’assurance et au profit de ses membres qui y adhèrent librement un contrat collectif en vue d’assurer la couverture d’engagements ou de risques est dit “ opération collective à adhésion facultative ”.

Pour l’application des dispositions générales relatives aux assurances de groupe du présent code dans le cadre d’opérations relevant du présent chapitre, la référence au souscripteur est remplacée par la référence à l’employeur ou, le cas échéant, à la personne morale, et la référence à l’adhérent est remplacée par la référence au salarié ou, le cas échéant, au membre de la personne morale.

Pour l’application de l’article L. 113-15, la référence à la police est remplacée par la référence au contrat collectif.

Pour l’application des articles L. 112-2, L. 112-3 et L. 113-2, la référence à l’assuré et la référence au souscripteur sont remplacées par la référence à l’employeur ou, le cas échéant, à la personne morale, à l’exception du quatrième alinéa de l’article L. 112-3 et des 2°, 3° et 4° de l’article L. 113-2, pour lesquels la référence à l’assuré est remplacée par la référence simultanée à l’employeur et au salarié ou, le cas échéant, à la personne morale et au membre de la personne morale.

Pour l’application de l’article L. 113-11, la référence à l’assuré est remplacée par la référence au salarié ou, le cas échéant, au membre de la personne morale ou au bénéficiaire.
