Article L211-9 of the French Tourism Code

The pre-contractual information communicated to the traveller forms an integral part of the contract and may not be modified, unless the contracting parties expressly agree otherwise. The organiser or retailer shall communicate all changes to the pre-contractual information to the traveller, in a clear, comprehensible and visible manner, prior to the conclusion of the contract.

If the tour operator or retailer has not fulfilled its obligations to provide information about additional costs, fees or other charges prior to the conclusion of the contract, the passenger will not be liable for such costs, fees or other charges.

The burden of proof concerning compliance with the information obligations set out in articles L. 211-8 and L. 211-10 lies with the professional.

Les informations précontractuelles communiquées au voyageur font partie intégrante du contrat et ne peuvent pas être modifiées, sauf si les parties contractantes en conviennent expressément autrement. L’organisateur ou le détaillant communique toutes les modifications relatives aux informations précontractuelles au voyageur, de façon claire, compréhensible et apparente, avant la conclusion du contrat.


Si l’organisateur ou le détaillant n’a pas satisfait aux obligations d’information concernant les frais, redevances ou autres coûts supplémentaires avant la conclusion du contrat, le voyageur n’est pas redevable desdits frais, redevances ou autres coûts.


La charge de la preuve concernant le respect des obligations d’information énoncées aux articles L. 211-8 et L. 211-10 incombe au professionnel.
