The commercial guarantee shall be provided to the consumer in a legible and comprehensible manner on any durable medium, and at the latest at the time of delivery of the goods. It specifies the content of the commercial guarantee, the procedures for implementing it, its price, duration, territorial scope and the name and postal and telephone contact details of the guarantor.
If these provisions are not complied with, the commercial guarantee remains binding on the guarantor.
In addition, the commercial guarantee shall state, clearly and precisely, that it applies without prejudice to the consumer’s right to benefit from the legal guarantee of conformity, under the conditions set out in this chapter, and that relating to hidden defects, under the conditions set out in articles 1641 to 1649 of the Civil Code. A decree will set out the terms and conditions of this information.
