Article L217-22 of the French Consumer Code

The commercial guarantee shall be provided to the consumer in a legible and comprehensible manner on any durable medium, and at the latest at the time of delivery of the goods. It specifies the content of the commercial guarantee, the procedures for implementing it, its price, duration, territorial scope and the name and postal and telephone contact details of the guarantor.

If these provisions are not complied with, the commercial guarantee remains binding on the guarantor.

In addition, the commercial guarantee shall state, clearly and precisely, that it applies without prejudice to the consumer’s right to benefit from the legal guarantee of conformity, under the conditions set out in this chapter, and that relating to hidden defects, under the conditions set out in articles 1641 to 1649 of the Civil Code. A decree will set out the terms and conditions of this information.

Article L217-22

La garantie commerciale est fournie au consommateur de manière lisible et compréhensible sur tout support durable, et au plus tard au moment de la délivrance du bien. Elle précise le contenu de la garantie commerciale, les modalités de sa mise en œuvre, son prix, sa durée, son étendue territoriale ainsi que le nom et les coordonnées postales et téléphoniques du garant.

En cas de non-respect de ces dispositions, la garantie commerciale demeure contraignante pour le garant.

En outre, la garantie commerciale indique, de façon claire et précise, qu’elle s’applique sans préjudice du droit pour le consommateur de bénéficier de la garantie légale de conformité, dans les conditions prévues au présent chapitre, et de celle relative aux vices cachés, dans les conditions prévues aux articles 1641 à 1649 du code civil. Un décret fixe les modalités de cette information.
