Article L221-1 of the French Consumer Code

I. – For the purposes of this Title, the following are deemed to be:

1° Distance contract: any contract concluded between a trader and a consumer, under an organised distance sales or service-provision scheme, without the simultaneous physical presence of the trader and the consumer, through the exclusive use of one or more means of distance communication until the conclusion of the contract;

2° Off-premises contract: any contract concluded between a trader and a consumer:

a) in a place other than that in which the trader carries on business on a permanent or regular basis, in the simultaneous physical presence of the parties, including following a solicitation or offer made by the consumer;

or
b) Or in the place where the trader carries on business permanently or habitually or by means of distance communication, immediately after the consumer has been personally and individually solicited in a place other than that where the trader carries on business permanently or habitually and where the parties were physically present at the same time;

c) Or during an excursion organised by the trader or by means of distance communication.
c) or during an excursion organised by the trader with the purpose or effect of promoting and selling goods or services to the consumer.
II. – The provisions of this Title apply to contracts for the sale of one or more goods, within the meaning of article 528 of the Civil Code, and to contracts under which the trader provides or undertakes to provide a service to the consumer in return for which the consumer pays or undertakes to pay the price. A contract which has as its object both the transfer of ownership of a good and the provision of a service, including the provision of delivery of goods, is treated in the same way as a contract of sale.

III. – The provisions of this Title shall also apply to contracts under which the trader provides or undertakes to provide the consumer with material-less digital content or a digital service and for which the consumer provides or undertakes to provide him with personal data, except where such data are processed exclusively by him to provide the material-less digital content or the digital service, or to enable him to fulfil his legal obligations.

Article L221-1

I. – Pour l’application du présent titre, sont considérés comme :

1° Contrat à distance : tout contrat conclu entre un professionnel et un consommateur, dans le cadre d’un système organisé de vente ou de prestation de services à distance, sans la présence physique simultanée du professionnel et du consommateur, par le recours exclusif à une ou plusieurs techniques de communication à distance jusqu’à la conclusion du contrat ;

2° Contrat hors établissement : tout contrat conclu entre un professionnel et un consommateur :

a) Dans un lieu qui n’est pas celui où le professionnel exerce son activité en permanence ou de manière habituelle, en la présence physique simultanée des parties, y compris à la suite d’une sollicitation ou d’une offre faite par le consommateur ;

b) Ou dans le lieu où le professionnel exerce son activité en permanence ou de manière habituelle ou au moyen d’une technique de communication à distance, immédiatement après que le consommateur a été sollicité personnellement et individuellement dans un lieu différent de celui où le professionnel exerce en permanence ou de manière habituelle son activité et où les parties étaient, physiquement et simultanément, présentes ;

c) Ou pendant une excursion organisée par le professionnel ayant pour but ou pour effet de promouvoir et de vendre des biens ou des services au consommateur.

II. – Les dispositions du présent titre s’appliquent aux contrats portant sur la vente d’un ou plusieurs biens, au sens de l’article 528 du code civil, et au contrat en vertu duquel le professionnel fournit ou s’engage à fournir un service au consommateur en contrepartie duquel le consommateur en paie ou s’engage à en payer le prix. Le contrat ayant pour objet à la fois le transfert de propriété d’un bien et la fourniture d’une prestation de services, y compris la prestation de livraison de biens, est assimilée à un contrat de vente.

III. – Les dispositions du présent titre s’appliquent également aux contrats par lesquels le professionnel fournit ou s’engage à fournir au consommateur un contenu numérique sans support matériel ou un service numérique et pour lesquels le consommateur lui fournit ou s’engage à lui fournir des données à caractère personnel, sauf lorsque ces données sont exclusivement traitées par lui pour fournir le contenu numérique sans support matériel ou le service numérique, ou lui permettre de remplir les obligations légales qui lui incombent.
