Article L224-112 of the French Consumer Code

Any professional who markets maintenance and repair services for motorised DIY and gardening tools allows consumers to opt for the use, for certain categories of spare parts, of parts from the circular economy instead of new parts.

A decree in the Council of State establishes the list of categories of DIY and gardening tools as well as the parts concerned and specifies the definition of parts from the circular economy, within the meaning of this article. It also defines the conditions under which the trader is not obliged to offer these parts due to their unavailability or other legitimate reasons, such as the safety of users.

The consumer information arrangements are set by decree.

In the event of a dispute, it is up to the trader to prove that he has fulfilled his obligations.

Tout professionnel qui commercialise des prestations d’entretien et de réparation d’outils de bricolage et de jardinage motorisés permet aux consommateurs d’opter pour l’utilisation, pour certaines catégories de pièces de rechange, de pièces issues de l’économie circulaire à la place des pièces neuves.

Un décret en Conseil d’Etat établit la liste des catégories d’outils de bricolage et de jardinage ainsi que des pièces concernées et précise la définition des pièces issues de l’économie circulaire, au sens du présent article. Il définit également les conditions dans lesquelles le professionnel n’est pas tenu de proposer ces pièces du fait de leur indisponibilité ou d’autres motifs légitimes, tels que la sécurité des utilisateurs.

Les modalités d’information du consommateur sont fixées par décret.

En cas de litige, il appartient au professionnel de prouver qu’il a exécuté ses obligations.
