Article L224-98 of the French Consumer Code

The contract provided for in article L. 224-97 includes the following information:

1° The full name and address of the professional purchaser or, in the case of a legal entity, its company name and the address of its registered office;

2° The unique identification number and, if the trader is registered with the trade and companies register, the wording RCS followed by the name of the town where the registry office where he is registered is located;

3° Where applicable, the individual identification number, if the professional is liable for value added tax and identified by an individual number pursuant to article 286 ter of the General Tax Code;

4° The full name and address of the consumer-seller;

5° The date and address of the place where the contract was concluded;

6° A precise description of the nature and characteristics of the goods covered by the contract, including the weight and, where applicable, the purity expressed in thousandths;

7° The sale price and any taxes or charges payable by the consumer/seller.
The contract includes a detachable form designed to facilitate the exercise of the right of withdrawal under the conditions set out in article L. 224-99.

The conditions for presenting this form and the information that must appear on it are specified by decree in the Conseil d’Etat.

Le contrat prévu à l’article L. 224-97 comporte les mentions suivantes :

1° Le nom et l’adresse complète du professionnel-acheteur ou, s’il s’agit d’une personne morale, sa raison sociale et l’adresse de son siège social ;

2° Le numéro unique d’identification, ainsi que, si le professionnel est immatriculé au registre du commerce et des sociétés, la mention RCS suivi du nom de la ville où se trouve le greffe où il est immatriculé ;

3° Le cas échéant, le numéro individuel d’identification, si le professionnel est assujetti à la taxe sur la valeur ajoutée et identifié par un numéro individuel en application de l’article 286 ter du code général des impôts ;

4° Le nom et l’adresse complète du consommateur-vendeur ;

5° La date et l’adresse du lieu de conclusion du contrat ;

6° La désignation précise de la nature et des caractéristiques des biens objets du contrat, dont le poids et, le cas échéant, la pureté exprimée en millièmes ;

7° Le prix de vente ainsi que toutes taxes ou tous frais éventuels à la charge du consommateur-vendeur.

Le contrat comprend un formulaire détachable destiné à faciliter l’exercice du droit de rétractation dans les conditions prévues à l’article L. 224-99.

Les conditions de présentation de ce formulaire et les mentions devant figurer sur ce dernier sont précisées par décret en Conseil d’Etat.
