Article L2312-2 of the French Labour Code

When, after the Social and Economic Committee has been set up, the number of employees in the undertaking reaches at least fifty for twelve consecutive months, the Committee exercises all the recurrent information and consultation powers defined in section 3 on expiry of a period of twelve months from the date on which the threshold of 50 employees has been reached for twelve consecutive months. If, at the end of this twelve month period, the remaining term of office of the works council is less than one year, this period runs from the date of its renewal.

Where the company does not have a social and economic committee, if the number of employees in the company has reached at least fifty for twelve consecutive months, the committee exercises all the powers defined in section 3 on expiry of a period of one year from the date of its establishment.

Lorsque, postérieurement à la mise en place du comité social et économique, l’effectif de l’entreprise atteint au moins cinquante salariés pendant douze mois consécutifs, le comité exerce l’ensemble des attributions récurrentes d’information et de consultation définies par la section 3 à l’expiration d’un délai de douze mois à compter de la date à laquelle le seuil de 50 salariés a été atteint pendant douze mois consécutifs. Dans le cas où, à l’expiration de ce délai de douze mois, le mandat du comité restant à courir est inférieur à un an, ce délai court à compter de son renouvellement.


Lorsque l’entreprise n’est pas pourvue d’un comité social et économique, dans le cas où l’effectif de l’entreprise atteint au moins cinquante salariés pendant douze mois consécutifs, le comité exerce l’ensemble des attributions définies par la section 3 à l’expiration d’un délai d’un an à compter de sa mise en place.
